পুঁজিবাজারে অস্থিরতার পেছনে জড়িতদের বিচার কেবল সেনা শাসনেই সম্ভব- খোন্দকার ইব্রাহিম খালেদের এই বক্তব্যকে 'উস্কানিমূলক' উল্লেখ করে ব্যারিস্টার রফিক-উল হক ও আনিসুল হকের মতো শীর্ষ আইনজীবীরা বলেছেন, ওই বক্তব্যে আদালতের ওপর অনাস্থা প্রকাশ পেয়েছে।
বৃহস্পতিবার একটি টেলিভিশন চ্যানেলকে দেওয়া ইব্রাহিম খালেদের ওই বক্তব্যের সমালোচনায় সাবেক অ্যাটর্নি জেনারেল রফিক-উল হক বলেন, "তার এ বক্তব্য উস্কানিমূলক, কেননা সামরিক শাসন অবৈধ, অসাংবিধানিক।"
যারা সেনা শাসনের পক্ষে উস্কানিমূলক কথা বলে, তাদেরও শাস্তি হওয়া উচিৎ বলে মন্তব্য করেন এই আইনজীবী।
বৃহস্পতিবার টেলিভিশন চ্যানেল বাংলাভিশনের এক প্রশ্নের জবাবে ইব্রাহিম খালেদ বলেন, "যদি মনে করেন যে, ধরে ধরে শাস্তি দিলে হবে। ধরে শাস্তি দেওয়া তো এতো সোজা না। আদালত আছে। আদালত তো সব সময় আসামির পক্ষে। কোর্ট কখনো নালিশকারীর পক্ষে থাকে না। '৯৬ সালে তো মামলা হয়েছিলো। একটারও তো জাজমেন্ট হয়নি।"
তার এ বক্তব্যকে অত্যন্ত দুঃখজনক উল্লেখ করে আরেক আইনজীবী আনিসুল হক বলেন, "এটা একেবারেই দায়িত্বজ্ঞানহীন বক্তব্য। অ্যান্ড ইট ইজ নট ট্রু। কোর্ট সব সময় আসামির পক্ষে থাকে- এ কথা মোটেই ঠিক নয়।"
কৃষি ব্যাংকের চেয়ারম্যান ইব্রাহিম খালেদ ওই টেলিভিশন চ্যানেলকে আরো বলেন, এ ধরনের অপরাধের বিচার সেনা শাসনের সময়ই দ্রুত সম্ভব হয়।
"এটা মার্শাল ল' তে হয়। ধরে এনে, বিচার করে শাস্তি দেওয়া যায়। এটা তো ডেমোক্রেসিতে হয় না।"
তার এ বক্তেব্যের সমালোচনায় বঙ্গবন্ধু হত্যা মামলায় রাষ্ট্রপক্ষের প্রধান আইনজীবী আনিসুল হক বলেন, "তার জানা উচিৎ, একটি সভ্য সমাজে মার্শাল ল' বলে কিছু থাকতে পারে না।
"উনি (ইব্রাহিম খালেদ) সামরিক শাসন নিয়ে যেটা বলেছেন, সেটা তো পুরো জুডিশিয়াল সিস্টেমের ওপর উনার লো কনফিডেন্স শো করছে। একজন রেসপনসিবল সিটিজেনের কাছ থেকে কখোনোই এ রকম বক্তব্য আশা করা যায় না।"
এ প্রসঙ্গে পঞ্চম সংশোধনী নিয়ে সুপ্রিম কোর্টের রায় ও আদালতের পর্যবেক্ষণের উল্লেখ করে রফিক-উল হক বলেন, "আদালত পরিষ্কার রায় দিয়েছে, সামরিক শাসন পুরোপুরি অবৈধ। ভবিষ্যতে অবৈধভাবে কেউ ক্ষমতা দখল করলে সংসদ, সংবিধান বা দণ্ডবিধিতে অবৈধ ক্ষমতা দখলকারীর শাস্তি নির্ধারণ করতে পারবে।"
বিগত তত্ত্বাবধায়ক সরকারের সময় দেশের দুই প্রধান রাজনৈতিক দলের নেত্রীর আইনজীবী হিসেবে দায়িত্ব পালনকারী প্রবীণ এই আইনবিদ বলেন, "তিনি (ইব্রাহিম) যা বলেছেন, তার অর্থ দাঁড়ায় তিনি সামারিক ট্রায়াল চেয়েছেন, আইনের শাসন নয়।"
দুই আইনজীবীই মনে করেন, ইব্রাহিম খালেদের বক্তব্যে বিচার ব্যবস্থার ওপর তার অনাস্থারই প্রকাশ ঘটেছে।
কৃষি ব্যাংকের চেয়ারম্যান ইব্রাহিম খালেদের নেতৃত্বাধীন চার সদ্যসের ওই তদন্ত কমিটি গত ৭ এপ্রিল অর্থমন্ত্রী আবুল মাল আবদুল মুহিতের কাছে তিন শতাধিক পৃষ্ঠার যে প্রতিবেদনটি জমা দেয় তা তৈরি হয়েছে মূলত শেয়ার বাজার সংশ্লিষ্টদের সাক্ষাৎকারের ভিত্তিতে।
সরকারের ভেতর ও বাইরে থেকে তদন্ত প্রতিবেদনটি অনুষ্ঠানিকভাবে প্রকাশ করার দাবি উঠলেও সরকার এখনো তা করেনি। তবে ওই প্রতিবেদনের একটি অনুলিপি হাতে পেয়েছে এবং তা ওয়েবসাইটে 'প্রকাশ' করা হয়েছে।
টেলিভিশনে ইব্রাহিম খালেদের বক্তব্যের প্রতিক্রিয়ায় আনিসুল হক বলেন, "আমার মনে হয়, উনি (খালেদ) যে রিপোর্টটি করেছেন, সেটা যে সঠিক নয়, এ ধরনের মন্তব্য করে তিনি সেটাই বলে দিচ্ছেন।"
এ বিষয়ে কথা বলার জন্য টেলিফোনে ইব্রাহিম খালেদের সঙ্গে যোগাযোগ করা হলে তিনি বলেন, "আমি আপনাদের সঙ্গে কোনো কথা বলবো না।"
The law minister has dismissed Khondoker Ibrahim Khaled's suggestion that trial only under martial law can ensure justice for alleged share market manipulators.
"There is no scope to hold the trial under martial law since it is not a law at all," Shafique Ahmed told on Friday.
"I differ with his [Khaled's] suggestion," the minister said, a day after the four-member inquiry panel chief Khaled came up with the suggestion in an interview with a private television station.
Quoting the Duke of Wellington Shafique, a barrister by training, said, "Martial law has no legal basis. It's a military dictator's rule. The state runs by his dictates in this system."
"Martial law," the Duke of Wellington told the British parliament "is neither more nor less than the will of the General who commands the army. In fact, martial law means no law at all."
"But it is clearly stated in the constitution" Shafique said "that state will be run in line with the constitution and the laws of the land."
Khaled told the Banglavision reporter on Thursday, "It's not easy to fast-track such trials. There are courts, and the court is always in favour of the accused."
"The court is never in favour of the accuser."
"Only martial law can fast-track such trials," he said in the interview. "You can take (them) into custody and hold summary trials. You cannot do that in a democracy."
The investigation chief pointed out that cases were also filed regarding the 1996 share scam but no judgement was passed.
Reacting to these remarks, Shafique said, "I don't know whether he made a mistake in explaining the matter. But criminal cases require that the responsibility lies with the state to prove any charge brought against anyone.
"So in such cases, the accused gets asked first to plead guilty or not guilty to the charges."
The minister said proceedings of several cases on the 1996 share market debacle have been frozen at the Appellate Division of the Supreme Court.
He, however, thinks that these cases could be disposed of if the right initiatives were taken.
Top lawyers Barrister Rafique-ul Haque and Advocate Anisul Huq fiercely criticised Khaled's remarks terming those "seditious" and "irresponsible".
When contacted, Khaled, also the Bangladesh Krishi Bank chairman, declined to comment on the law minister's remarks.
Khaled submitted his 300-page report on Apr 7 which the government decided not to publish immediately, leading to calls that the findings be made public.
Three days later, , which got hold of a copy, uploaded the report on its site.
